NWEA REPRESENTATIONS, WARRANTIES AND LIMITATIONS OF LIABILITY

NWEA IS NOT RESPONSIBLE FOR THE VALIDITY, FAIRNESS OR QUALITY OF ASSESSMENTS FOR HOMESCHOOL USE. NWEA WILL HAVE NO LIABILITY UNDER THE LICENSEE’S AGREEMENT WITH COMPANY. IN NO EVENT SHALL NWEA BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, PUNITIVE OR OTHER INDIRECT DAMAGES. FURTHERMORE, NOTWITHSTANDING ANYTHING CONTAINED IN THE AGREEMENT TO THE CONTRARY, UNDER NO CIRCUMSTANCES SHALL NWEA BE LIABLE TO LICENSEE OR ANY THIRD PARTY FOR ANY DAMAGES IN EXCESS OF THE FEES PAID TO NWEA BY OR ON BEHALF OF THE LICENSEE PURSUANT TO THE LICENSE OR THE LICENSEE’S AGREEMENT WITH COMPANY DURING THE TWELVE-MONTH PERIOD IMMEDIATELY PRECEDING SUCH CLAIM.
TESTING PROTOCOL
Licensee understands and agrees that test items in the Products are NWEA property, subject to all copyright protections under federal and state laws, and must be kept confidential. STUDENT DATA
Licensee acknowledges and agrees that because Company is aggregating multiple homeschool students under a single license to the Products, Company will control how user roles to the Products are configured for all its clients (including students, families and homeschool service providers). It is AHTS’s policy to respect your privacy regarding any information we may collect while operating our websites.
WEBSITE VISITORS
Like most website operators, AHTS collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. AHTS’s purpose in collecting non-personally identifying information is to better understand how AHTS’s visitors use its website. From time to time, AHTS may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.
AHTS also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged-in users. AHTS only discloses logged-in user IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below.
GATHERING OF PERSONALLY-IDENTIFYING INFORMATION
Certain visitors to AHTS’s websites choose to interact with AHTS in ways that require AHTS to gather personally-identifying information. The amount and type of information that AHTS gathers depends on the nature of the interaction. For example, we ask visitors who sign up for our mailing list to provide a name and email address. Those who engage in transactions with AHTS—by purchasing testing services, for example—are asked to provide additional information, including as necessary the personal and financial information required to process those transactions. In each case, AHTS collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with AHTS. AHTS does not disclose personally-identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.
AGGREGATED STATISTICS
AHTS may collect statistics about the behavior of visitors to its websites. AHTS may display this information publicly or provide it to others. However, AHTS does not disclose personally-identifying information other than as described below.
PROTECTION OF CERTAIN PERSONALLY-IDENTIFYING INFORMATION
AHTS discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors, and affiliated organizations that (i) need to know that information in order to process it on AHTS’s behalf or to provide services available at AHTS’s websites, and (ii) have agreed not to disclose it to others. Some of those employees, contractors, and affiliated organizations may be located outside of your home country; by using AHTS’s website, you consent to the transfer of such information to them. AHTS will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors, and affiliated organizations, as described above, AHTS discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when AHTS believes in good faith that disclosure is reasonably necessary to protect the property or rights of AHTS, third parties, or the public at large. If you are a registered user of an AHTS website and have supplied your email address, AHTS may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with AHTS and our products. We primarily use our various product blogs to communicate this type of information, so we expect to keep this type of email to a minimum. If you send us a request (for example, via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. AHTS takes all measures reasonably necessary to protect against the unauthorized access, use, alteration, or destruction of potentially personally-identifying and personally-identifying information.

Affordable Homeschool Testing Services LLC is offering three testing terms during the 2025–2026 school year. This is our policy for retests during the same term.
If a student becomes ill during or shortly after testing, the client should contact us within 24 hours of completing the test, and we will attempt to schedule a retest and reschedule the rest of the test session for no additional cost. If multiple children are scheduled to be tested at the same time, the client may choose whether or not to reschedule everyone.
If the client becomes aware of an issue that may interfere with the accuracy of the test during testing, contact the proctor immediately, and we can cancel the current test and allow the student to restart. If you become aware of the issue after testing, inform us within 24 hours, and we will attempt to schedule a retest for no additional cost.
If the system finds that a student’s test has an unusually high error margin, we will contact the customer and offer the option of retesting at no charge, possibly with a higher-level test. If the system does not generate a score because it detected excessive guessing, we will offer the option of retesting at no charge.
Once a score report has been generated and delivered to the customer, we will not allow the student to retest during that term.
Affordable Homeschool Testing Services LLC reserves the right to limit the number of retests offered to a client. Retesting is subject to appointment availability and must be completed during the same term as the initial test.
If an appointment is canceled 24 hours or more in advance of the beginning of testing, we will completely refund your payment.
If an appointment is canceled less than 24 hours before the scheduled time due to illness or family emergency, we do not guarantee a refund but will attempt to reschedule the appointment for a later date. Once testing has begun, it must be completed in the same test session.
